CAMP OUT SIGN UP & FUNDRAISE COMPETITION TERMS AND CONDITIONS

  1.  The Promoter is Camp Quality Limited (the Promoter) of Suite 5.01, 77 Pacific Highway, NSW 2060 (ABN 87 052 097 720). Camp Quality phone: 02 9876 0500.

 METHOD OF ENTRY

  1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
  2. The competition period starts on Thursday,15 June 2023 at 7:00 AM (AEST) and ends on Sunday, 30 July at 11:59 PM AEST (the Competition Period).
  3. Entry is open to all permanent residents of NSW, QLD, VIC, ACT, NT, SA, WA and TAS, aged 18 years or older (Eligible Entrants).
  4. Employees of the Promoter are ineligible to enter.
  5. To be eligible for the prize draw, Eligible Entrants must, during the Competition Period;

6.1 Register and activate a Camp Out online fundraising page.

6.2 Fundraise $55 or more using their personal online fundraising page on camp-out.org.au by 11:59pm on Sunday, 30 July 2023, which is the date the promotion ends.  

  1. To be deemed valid, registration entries are required to meet the following requirements:
  • The Camp Out Registration Form must be successfully completed, answering all mandatory fields and providing a valid email address, and submitted in accordance with entry requirements. 
  • Incomplete, illegible, indecipherable or incorrect Camp Out Forms will be deemed invalid.
  • There is a limit of one entry per Eligible Entrant during the Competition Period.
  • Entrants can only enter the Competition in their own name.
  • Entrants acknowledge their entry/entries may be responded to and/or displayed at the Promoter’s sole discretion.

PRIZES AND NOTIFICATION

  1. One winner will be chosen at random by electronic draw, which will take place on Monday, 31 July 2:00pm (AEST), at Camp Quality, of Suite 5.01, 77 Pacific Highway, NSW 2060 Entrants need not be present to win.
  2. The Prize is one $3,000 NRMA Parks and Resort Voucher. The Prize conditions include:
    • The voucher is valid for 12 months and is subject to availability.
    • The voucher can be used at any NRMA Parks or Resorts, excluding managed properties such as NRMA Echuca Holiday Park, NRMA Stockton Beach Holiday Park, NRMA Sydney Lakeside Holiday Park, NRMA Shellharbour Beachside Holiday Park and NRMA Batemans Bay Holiday Resort.
    • The voucher can only be redeemed during low and mid-seasons, no further discounts or specials apply.
    • The prize is not transferable, or redeemable for cash.

    • The Winner will be awarded the Prize based on the above criteria
  3. Determination of the Winner is at the sole discretion of the Promoter and no correspondence will be entered into.
  4. The Winner will be notified in writing (via email) and the Winner’s details (first initial, surname, state) will be published on the Camp Out website, camp-out.org.au within 2 days of the winner being drawn.
  5. Upon being notified, the Winner must nominate an email address for the Prize to be sent within 14 days by contacting the Promotor by return email.
  6. If for any reason a Winner does not redeem the prize by the time stipulated by the Promoter, then the prize will be forfeited.
  7. If the Winner is under 18 years of age at the time of the determination of the winning entries, the Prize must be accepted on the Winners’ behalf by the Winners’ parent or guardian.
  8. The prize pool is valued up to $3,000 RRP.
  9. The Promoter reserves the right to disqualify any Eligible Entrant where, in the opinion of the judges, the Eligible Entrant has engaged in, or the Eligible Entrant’s fundraising page includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The Promoter’s decision is final, and no correspondence will be entered into.
  10. All registrations become and remain the property of the Promoter. The Promoter may use the Eligible Entrants' names and addresses for promotional, marketing and publicity purposes.
  11. The Winner must agree to be contacted by the Promoter via email. The Winner must also acknowledge they have read and understood these terms of entry.
  12. The Promoter reserves the right to request the Winner to provide proof of identity and/or proof of entry validity, in order to claim the Prize. Acceptance of the form of proof of identification, and entries considered suitable for verification is at the discretion of the Promoter. In the event that a Winner cannot provide proof, the Winner will forfeit the Prize and no substitute will be offered.
  13. The Promoter accepts no responsibility for failure to deliver the Prize to the Winner in circumstances where the nominated prize email address is not a valid email address, or the Winner is no longer available at that email address.
  14. There may be circumstances in which the Promoter cannot provide the Prize as described for reasons beyond its reasonable control. In those circumstances, the Promoter will provide an alternative prize or prizes of equal or greater value to the promoted prizes.
  15. Prizes are not transferable or exchangeable and cannot be redeemed as cash.
  16. The Promoter accepts no responsibility for any loss, damages, or injury incurred to enter the competition or in connection with taking up the prizes.
  17. Neither the Promoter nor their agents will be held liable for not redeeming the prize within the designated time frame.
  18. Neither the Promoter nor their agents are responsible, to the extent permitted by law, for acts of God, acts of terrorism or war (declared or undeclared) or other events beyond their control which prevents awarding or acceptance of the Prize in accordance with the prize description.
  19. The Winner will be awarded the Prize based on the above criteria.

FINAL CONDITIONS

  1. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
  2. It is a condition of accepting the Prize that the Winners must comply with all the conditions of use of the Prize.
  3. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal or permanent injury or loss of life; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  4. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alterations of entries, and reserves the right to take any action that may be available. If for any reason this competition is not capable of running as planned, due to causes including, but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter  reserves the right in its sole discretion, to the fullest extent permitted by law, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to state regulations.
  5. All details of the entrants will be used and preserved in accordance with the Australian Privacy Principles and the Promoter’s Privacy Policy, available https://www.campquality.org.au/privacy-policy/. A request to access, update or correct any information should be directed to the Camp Quality Privacy Officer. Unless otherwise notified, the Promoter may use the entries and details of entrants for promotional and publicity purposes. Entrants consent to their full names and/or their entries being used in all media by the Promoter.
  6. Entrants acknowledge this competition is in no way associated with or endorsed by Facebook. Any information disclosed by entrants entering this competition is not provided to Facebook.



FUNDRAISING TERM & CONDITIONS

 

  1. These terms relate to the co-ordination of an event/activity with the aim of raising funds for the benefit of Camp Quality.
  2. “Fundraiser" means the individual, group or organisation holding the activity or event in conjunction with or for the benefit of, Camp Quality.
  3. Once the Fundraiser agrees and acknowledges these terms through this online form, Camp Quality will then send an Authority to Fundraise, which confirms and authorises the activity/event. You are then able to start fundraising.
  4. Fundraisers are not authorised to use Camp Quality as their beneficiary charity until they have received the Authority to Fundraise, as this safeguards everyone involved.
  5. You may fundraise during the Competition Dates (referred to in the Camp In Registration Terms and Conditions below) only, and only for the approved event or activity indicated in your Letter of Authority. If you wish to extend or change any aspect of your fundraising event or activity, you will need to seek additional approval from Camp Quality.
  6. The activity/event is the responsibility of the Fundraiser and due to limited resources, Camp Quality are unable to assist in soliciting prizes, organising publicity, or providing goods and services unless agreed to in writing with the Fundraiser.
  7. If you are soliciting In Kind goods, asking for free or discounted good and/or services for your authorised fundraising event these items should be used for the event/activity intended. If items are not utilised for the event/activity, the item should be donated to Camp Quality.
  8. Camp Quality does not allow individual community fundraisers authorised on behalf of Camp Quality, to raise funds through telemarketing or door-to-door solicitation. Both forms of fundraising have strict legislative requirements and are managed nationally by Camp Quality.
  9. If the Fundraiser wishes to use the Camp Quality logo and or name on any printed materials such as, but not limited to, flyers, posters, invites, then an example of the material should be sent to Camp Quality for approval before use.
  10. At Camp Quality, we respect the privacy of our children and families. We will look at any requests to involve children and/or their families on an individual basis.
  11. It is essential that Fundraisers contact Camp Quality to gain approval before they contact or approach any public personality or celebrity so that we can maximise the opportunity via the Camp Quality network.
  12. If the Fundraiser would like a representative of Camp Quality to attend the activity/event, they should notify Camp Quality as early as possible to enable a representative to be available. Please note; not all requests will be able to be met as staff availability is limited.
  13. Camp Quality is registered as a charity with the Australian Charities and Not for Profits Commission and operates under numerous State charity licences. When fundraising for our benefit you must comply with all laws and regulations relating to charitable fundraising as well as any conditions of the Camp Quality licences to undertake fundraising that apply to you or your activity. Please contact your local Camp Quality office for more details.
  14. All monies collected must be counted/verified and witnessed by a minimum of two people and accurately recorded (by the Fundraiser) as outlined by charitable fundraising laws and regulations in your state. This documentation of income and expenses (associated with the fundraising event) must then be presented to Camp Quality.
  15. Funds must be remitted to Camp Quality within 4 weeks of your fundraising event. Once funds raised have been remitted, Camp Quality will issue a receipt in the name of the activity/event.
  16. The Fundraiser must take all reasonable steps to ensure that the expenses do not exceed 40% of gross proceeds or a lower percentage as required by law and they must keep records of income and expenditure
  17. Your event/activity is not covered by Camp Quality’s public liability insurance. You must make sure that your own insurance policy covers any risk associated with your fundraising activity or event.
  18. Camp Quality is committed to safeguarding the welfare of children and young people. If children are present during the activity/event, the Fundraiser must ensure the safety of child/ren by adequately supervising them and ensuring that there are always two adults present (unless the child’s parent/guardian is present). If the Fundraiser is concerned about the safety and welfare of a child, they should contact 1800 CQ SAFE (1800 277 233).
  19. Individual receipts for tax deductions for attendee/supporters of the activity/event will only be issued by Camp Quality if a general donation of $2.00 or more is made. When the attendee/supporter has given money in return for goods or services, a tax-deductible receipt cannot be issued. Camp Quality cannot issue any receipts until the funds are deposited into the Camp Quality account.
  20. Camp Quality reserves its right to withdraw its approval for the activity/event at any time if it appears that the Fundraiser is failing to adhere to any of the above terms and conditions.
  21. At all times, before, during or after your fundraising event/activity you must conduct yourself with decency, dignity and good taste and in a manner, that does not harm or diminish Camp Quality’s good name in the community. Fundraisers must be aware that when they represent Camp Quality the following behaviour is NOT acceptable:
    behaviour that threatens or endangers others;
    • use of illicit drugs, any type of ‘substance abuse’ or intoxication; and/or
    • use of inappropriate language.

State Fundraising Requirements

It is your responsibility to obtain any necessary permits or licenses for your fundraising activity, and to review fundraising regulations with your state authority – particularly if you are a registered business and/or organising a raffle or auction.

PERSONAL DATA COLLECTION STATEMENT

 

  1. Policy Statement

1.1 Camp Quality respects and is committed to protecting the privacy of the individuals whose personal information it collects. We are bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth).

1.2 This policy lists the personal information we collect from various individuals, how we collect, why we need the information and to whom we disclose the information. It details how stakeholders can make a complaint regarding any privacy issue or concern.

  1. Definitions

2.1 Government related identifiers: are identifiers assigned by an agency, State or Territory authority, an agent of an agency or authority, or a contracted service provider for a Commonwealth or State contract.

2.2 Involved person: an individual connected to Camp Quality operations, activities and events - including employees, donors, research study participants, recipients of support services including individuals attending our camps, participants in advocacy campaigns or health promotion projects such as our puppet shows, suppliers, volunteers and service providers.

2.3 Personal information: information or an opinion about an individual who is identified by the information, or whose identity can be easily ascertained from the information. Examples of Personal Information we may collect include name, address, tax file number, credit information or any information from social media, and online data collection.

2.4 Sensitive Information: includes information which may not identify an individual but includes important details, such as specific health or medical information, a person's race, religion, political opinions, affiliations, philosophy, memberships or genetic information.

2.5 Use: all activities involving Personal Information such as collecting, recording, disclosure, organisation, retrieval, processing, aligning, combining, or deleting of Personal Information.

  1. Policy Practice and Procedure

4.1 Collecting personal information of involved persons

4.1.1 Where possible Camp Quality collects personal information directly from involved persons, in person, on the telephone, via mail, email or online.

4.1.2 Some information is also collected from third parties such as contractors, health professionals, government bodies and social services.

4.1.3 In circumstances where information has been collected from third parties, and it is not clear whether we have permission from the individual to disclose the information, Camp Quality takes reasonable steps to obtain such permission and ensures the purposes for which information is collect is made clear. Camp Quality collects information for several purposes, including but not limited to:

  • marketing;
  • fundraising;
  • providing services and programs; and
  • health promotion.

4.2 Use of personal information

4.2.1 Camp Quality uses personal information for the purpose for which:

  • it has been provided;
  • it is reasonably related to secondary purposes, which are within the contemplation of the parties (and are directly related, if the information is sensitive information);
  • any other purpose you have consented to; and
  • any other purpose permitted under the Privacy Act 1988 (Cth). This may include:
    • verification of identity;
    • to enable Camp Quality to establish and administer its services;
    • for the purposes of managing relationships with families;
    • handling enquiries
    • to handle communications with individuals, agencies or representatives;
    • to comply with legal and regulatory obligations including any recommendation, request, rule, order or direction of any regulatory, governmental authority, court or tribunal;
    • to conduct marketing activities, including research and analysis in relation to Camp Quality;
    • to provide electronic communications;
    • to conduct recruitment processes, including the assessment of suitability for future roles; and
    • any other purposes related to the above.

4.3 Disclosure of personal information

4.3.1 Camp Quality discloses personal information for the purposes for:

  • which it has been provided;
  • reasonably related secondary purposes which are within the contemplation of the parties (and are directly related if sensitive information);
  • any other purpose you have consented to; and
  • any other purpose permitted under the Privacy Act 1988(Cth).

4.3.2 Depending on the services, or the relationship to Camp Quality, your personal information may be disclosed to:

  • an employer;
  • a bank or financial institution;
  • to third party suppliers and vendors to the extent necessary for the establishment, provision, and administration of the applicable services
  • an insurer;
  • personnel, agents, contractors and service providers involved in providing managing or administering services;
  • companies who provide information and infrastructure systems to Camp Quality, including cloud storage providers;
  • anyone acting on an individual’s behalf;
  • professional advisors, consultants, accountants, lawyers and auditors;
  • to anyone to whom consent has been provided;
  • where required to do so by law; and
  • for any other purpose related to the above.

4.4 Direct Marketing

4.4.1 Personal information may be used from time to time to distribute current information pertaining to areas including (but not limited to) services and programs, fundraising events and opportunities, and changes to Camp Quality.

4.4.2 By providing personal information, consent is given to receiving such information, including by phone, email, SMS, and social media, until the individual unsubscribes.

4.4.3 Sensitive information will not be disclosed for direct marketing purposes unless consent is provided for that kind of disclosure.

4.5 Cookies, advertising, and tracking

4.5.1 Your IP address is the identifier for your computer when using the internet.  Your IP address may be collected for you to interact with Camp Quality’s website.

4.6 Using government related identifiers

4.6.1 Government related identifiers (eg. drivers licence number or tax file number) will not be disclosed other than to the extent required or authorised by law. 

4.7 Protecting personal information of involved persons

4.7.1 Camp Quality holds personal information securely, both electronically and in hard copy files.

4.7.2 Camp Quality takes reasonable steps to protect personal information from misuse, interference, and loss and from unauthorised access, modification, and disclosure. These steps include:

      • using Payment Card Industry Data Security Standards (‘PCIDSS’) software and processes; and
      • restrictions on the employees and/or volunteers who have access to personal files.

4.7.3 Camp Quality takes reasonable steps to ensure, when the information is no longer needed, it is destroyed or permanently rendered anonymous.

4.8 Access or correct your personal information

4.8.1 Camp Quality seeks to ensure all personal information collected and stored in its files and database systems is correct and accurate.

4.8.2 Individuals may at any time request access to, or correction of, the personal information Camp Quality holds by contacting the Privacy Officer.

4.8.3 Camp Quality will endeavour to meet or advise of the outcome of such a request within five business days of receipt.

4.8.4 Camp Quality relies on individuals to inform if the information held is inaccurate and / or incomplete.

4.9 Making a Complaint

4.9.1 For any privacy issues or concerns, including a complaint that Camp Quality has breached the Australian Privacy Principles, contact the Privacy Officer. Phone: 02 9876 0500 or email: [email protected] or [email protected]

4.9.2 We may request you make your complaint in writing. Camp Quality will respond to your complaints within a reasonable period (usually 30 days).
